The Workplace Relations Commission found Younis Sarwari’s race discrimination and harassment complaint against Clancourt Management Unlimited Company T/AClancourt Management not well founded. The decision was dated 6 April 2023. Sarwari, who worked as a security guard at Crescent Shopping Centre in Limerick, alleged that a manager called him a monkey during an exchange at work. The respondent denied the allegation and said the manager had asked him to remove his hands from his pockets while on duty. A Subway worker, Joga Singh, said he heard the manager say Sarwari looked like a monkey. The adjudication officer found Sarwari’s evidence unreliable and unpersuasive, citing conflicts between the accounts and inconsistencies in his evidence. The officer accepted the respondent’s position that Sarwari was not treated less favourably because of his race. The WRC concluded that Sarwari had not established a case of race discrimination and found no evidence that he was discriminated against or harassed on racial grounds. The complaint was not well founded.
