WRC rejects race discrimination complaint against First Care

The Workplace Relations Commission rejected Uchenna Jude Dike’s race discrimination complaint against First Care, finding no prima facie case of discrimination. The decision is dated 1 March 2023. Dike alleged that a colleague made a racist comment about his height and colour, that it led to his dismissal, and that he was discriminated against when annual leave was refused. First Care said his performance and working relationships were unsatisfactory. It attributed the leave refusal to balancing staff requests. The WRC found the complaint was within the statutory time limit. It noted that colleagues’ emails did not refer to race or colour and that Dike had provided no evidence of the alleged discriminatory comments. The complaint failed.
