The Workplace Relations Commission ordered the Health Service Executive to pay Diane O’Mahony €23,542.71 gross in wages after finding she should have returned to full-time pay when her job-sharing arrangement ended. The decision was dated 3 February 2023.

Ms O’Mahony began a three-year job-sharing arrangement in 2017. Her job-sharing partner left in 2019 and was not replaced. Her contract provided for a return to full-time work after at least three years, if a suitable vacancy was available. The adjudication officer found Ms O’Mahony met those conditions and that a full-time role was available. The officer said her full-time salary was not paid because her manager failed to process it.

The award covers wages properly payable from 18 December 2020 to 17 June 2021, the period the officer could consider under the time limit. The HSE did not attend the hearing. Ms O’Mahony’s separate complaint under the Employment Equality Act was withdrawn.
