The Workplace Relations Commission awarded Martina Collins Condon €18,461 after finding she was unfairly selected for redundancy and unfairly dismissed. The WRC decision was dated 3 February 2023.

Collins Condon worked as an Accounts and Payroll Assistant for Bishopsisland Plant Hire & Groundworks Ltd. The company said her redundancy followed a fall in trading during the pandemic. The WRC found that a genuine redundancy had occurred, but the employer had not shown that its selection method was fair.

The adjudication officer said the process lacked preparation, consultation and fair procedures, and that Collins Condon had not received a proper opportunity for representation or appeal. The WRC also considered her mitigation efforts and her contribution to the dismissal when setting compensation; it said it would have preferred to see more extensive efforts to limit her losses.

The WRC separately awarded her €769.24 because the company had not provided written terms of employment. A duplicate unfair dismissal complaint was withdrawn at the hearing.
