The Workplace Relations Commission found Hong Yen Foh’s race discrimination complaint against Wakely Engineering Limited not well-founded. Its decision, dated 12 October 2022, also concluded that his victimisation, other discrimination and discriminatory dismissal complaints must fail. Foh worked in the company’s design office from March 2018 to April 2021. He said disciplinary action followed work mistakes and alleged that management used it to force him out, including over his employment permit. The company said the disciplinary process concerned his work performance and that Irish employees also faced disciplinary action. The WRC said Foh had not shown additional evidence such as a difference in status or treatment and had failed to discharge the burden of proof.
