The Workplace Relations Commission found that TikTok Technology Limited did not discriminate against Hatem Mohamed on age grounds when it did not offer him a job after three interviews. The decision, dated 12 October 2022, said Mohamed had not established primary facts showing age discrimination, so the complaint was not upheld.

Mohamed said an interviewer asked how he would work with a team leader in their twenties. The adjudicator found that the question was not asked and that no team leader had yet been recruited. The decision said Mohamed was not selected because he was belligerent and disrespectful while waiting for the interview results.

TikTok said its recruitment process was transparent and fair, with recruiters trained in non-discriminatory selection techniques. It said Mohamed’s conduct while seeking the interview result led to the decision not to offer him the job.
