The Workplace Relations Commission found Simon McDonnell’s dismissal by Acacia Facilities Management Limited fair and rejected his complaint that wages were owed after his employment ended. McDonnell said his manager knew he relied on public transport to get to and from his security shifts. The company said it dismissed him for repeatedly failing to work his full shifts. The adjudicator found McDonnell had no basis to claim that his attendance arrangement had the employer’s approval. The disciplinary letter gave him the information and rights needed to prepare, and any defect in preliminary fact-finding was remedied before the disciplinary hearing. The adjudicator found no evidence that the outcome was predetermined and considered dismissal within the range of reasonable sanctions. The decision was dated 12 October 2022.
