The WRC awarded Javier Fernandez Torres €768 after finding Sitting Tree Ltd Harbour Bar failed to provide required employment information on time and left expected working hours unclear. The decision, dated 10 August 2022, also found a second information complaint well founded, but made no further award for it. Torres said the employer changed his shifts without adequate notice and penalised him for asserting his rights. The company said Covid reopening pressures delayed the contract and that his limited availability made him a poor fit during probation. The WRC found the penalisation complaint not well founded. It said there was no single operating cause that predominated in the dismissal: the dispute over hours was a factor, as was Torres's limited availability. The €768 award was four weeks of his €192 weekly pay. The employer was also required to specify the hours he could reasonably expect to work in a normal day and week.
