The Workplace Relations Commission found that Kellor Services (Ire) Ltd. victimised employee Jacek Kozik after he brought an earlier WRC complaint, and ordered the company to pay him €11,250. The decision was dated 5 April 2023.
Kozik said the company had not given him updated employment terms or a handbook setting out grievance and disciplinary procedures. The WRC found an ongoing failure to provide a comprehensive contract and access to a grievance procedure, leaving him without an effective internal way to raise a complaint. It awarded €3,000 for that breach and ordered the company to provide a compliant contract, grievance procedure and disciplinary policy within 42 days.
The WRC also found that Kozik was treated adversely in reaction to his earlier complaint, including being kept on lay-off longer than colleagues and being delayed in returning to work while less experienced Romanian workers returned. It found the company victimised him and awarded €11,250, equivalent to about 15 weeks' wages at €750 a week.
