WRC finds worker’s constructive dismissal complaint out of time

The WRC found a worker’s constructive dismissal complaint was out of time and not well founded. The adjudication officer also considered the claim and found the worker had not shown that the employer’s conduct left him with no reasonable option but to resign. The decision was dated 20 January 2023. The worker said the employer’s refusal to transfer him to Dublin left him no choice but to resign. The employer denied constructive dismissal, saying he resigned to take another job, and cited accommodations it had offered, including remote work.
