The Workplace Relations Commission did not recommend that a health service provider regularise a worker as a Clinical Nurse Manager 1 after the worker’s acting appointment ended. The recommendation was dated 20 January 2023. The Psychiatric Nurses Association (PNA), representing the worker, said he met four of five criteria under a 2020 circular and that the employer’s handling of his appointment and grievance kept him from meeting the last one. The employer said he no longer held the acting post when the circular was issued and had not applied through a national recruitment competition. The WRC noted that the provider and PNA had agreed from March 2020 to fill vacant CNM1 posts from national panels. The process to fill the worker’s post began before later advice about planned permanent appointments. The officer did not recommend in favour of the worker’s claim.
