The Workplace Relations Commission found Marie Vaughan was not discriminated against on disability grounds by Bannon Commercial Property Consultants Ltd. The decision, dated 14 December 2022, concerned an incident at CastleWest Cork Shopping Centre, where Vaughan said a manager told her she could not use the centre without a face mask.
The company said the centre manager was employed by B.S.C. Management Ltd., not Bannon, and the adjudicator agreed that the statutory vicarious-liability provision applied to B.S.C. Management Ltd. The decision also records that no evidence of a disability or mask exemption at the time of the incident was provided.
