The Workplace Relations Commission found that Marie Vaughan was not discriminated against on grounds of disability at CastleWest Cork Shopping Centre. The decision, dated 14 December 2022, followed her complaint about being told she could not use the centre without a mask.
Vaughan said the centre manager told her to leave because she was not wearing a mask. B.S.C. Management Ltd. said its manager reminded her of the face-covering requirements and offered her a visor.
The adjudication officer found no medical evidence of a disability at the time and said the conditions Vaughan described did not meet the definition of disability under the Equal Status Act. The officer also found she had been treated the same as other customers.
