The WRC found Brendan Dempsey’s payment of wages complaint against Napier Couriers Limited t/a Fastway Couriers Ireland not well founded. The decision was dated 25 May 2022. Dempsey said he worked 21 days without a break and was not paid. The company argued that a recruitment agency had sent him to the depot and that he was not its employee. The officer accepted that Dempsey was an agency worker employed by an agency and assigned to the company. Although the company managed his work day to day, the officer found it was not his employer for the purposes of the Payment of Wages Act.
