The Workplace Relations Commission found Audrey Carey’s complaint over Rentokil Initial Limited’s move from fortnightly to monthly pay was brought outside the time limit and was not well founded; the merits were not decided. The decision was dated 23 February 2023. Carey argued that the change breached employment terms transferred from her previous employer. Rentokil Initial Limited said the complaint was late because she had transferred to the company three years earlier. The WRC found the six-month limit, or up to 12 months in some circumstances, had expired. Carey’s separate Payment of Wages Act complaint was withdrawn at the hearing. The adjudicator said a change to pay frequency without agreement required consideration under different legislation.
