The Workplace Relations Commission awarded Nigel Harris €26,696 after finding he was unfairly dismissed by Ronan Blanchfield Environmental Services Ltd. Its decision was dated 20 February 2023.

Harris said he was dismissed without notice or redundancy pay after being laid off in September 2020. The company said the layoff was temporary and his position remained open. The adjudicator found he had been dismissed and that the company had no intention of reengaging him. The WRC said there were no substantial grounds for dismissal and no fair procedure.

The compensation was reduced by 25% because Harris did not take steps to limit his losses. The WRC also awarded €1,755, equivalent to three weeks’ pay, for the minimum-notice complaint. His redundancy complaint was not well founded because his role was not redundant and redress was awarded under the Unfair Dismissals Act.
