The Workplace Relations Commission did not uphold Humayun Arbab’s complaints that Securway At Risk Security Group Limited discriminated against him on race or disability grounds, victimised him or constructively dismissed him. The decision was dated 20 February 2023. Arbab, a security supervisor at a Dublin hospital, said he was denied retrospective supervisor allowance, received less sick pay than an Irish colleague and was demoted after an interview for a revised supervisor role. He also alleged disability discrimination and victimisation, and said he resigned because of discriminatory treatment. The adjudicator found the evidence did not show that race affected the demotion decision. The Irish colleague’s extended sick pay was linked to a workplace injury benefit that did not apply to other employees. The evidence also did not establish the required initial case of disability discrimination or victimisation. The adjudicator accepted that Arbab had a legitimate complaint about the delayed allowance payment, but did not find that he was constructively dismissed on discriminatory grounds.
