The WRC found Geraldine Fitzmaurice’s complaint against Dublin Bus was outside its jurisdiction and was not upheld in a decision dated 28 February 2022; the merits were not decided.
Fitzmaurice said she had a medical exemption from wearing a mask when she tried to board a Dublin city bus on 3 September 2020. The adjudicator found she was inadequately prepared to present her exemption to the driver, who appeared to have mismanaged a difficult situation.
The WRC found the required notice was served outside the four-month limit and the complaint was also one day late. It found no sufficient explanation or exceptional circumstances to extend the deadlines.
