The Labour Court found six complaints by Rachel Hickey against QED Contracts Limited and DHL Express (Ireland) Limited not well founded in a determination dated 28 February 2022. Hickey, an Operations Clerk employed by QED and assigned to DHL, said she was underpaid, denied a productivity bonus and penalised by suspension. She also complained that DHL failed to tell her about vacancies and denied her access to its online training portal. The Court rejected her pay-rate claim, preferring DHL’s sworn evidence about pay to Hickey’s hearsay evidence. It found she had not done piece work and was not eligible for a productivity bonus, and that she identified no vacancy she had missed. It also found that training-portal access was not covered by the relevant provision. The Court found QED suspended Hickey because she attended work against instructions and refused to leave, not because she said she intended to make a complaint. It found no evidence that DHL suspended her. An earlier €100 award had been paid and accepted, so that issue was not before this division.
