The Workplace Relations Commission found it had no jurisdiction to hear three complaints by Michail Michailidis against Luxor Leisure Ltd Radisson Blu Royal Hotel because they were referred outside the statutory time limit. The merits were not decided. The WRC decision, dated 17 August 2022, concerned claims of race discrimination and penalisation linked to Michailidis’s dismissal in March 2020, when the hotel reduced its operations amid COVID-19 restrictions. The respondent denied the claims. Michailidis said COVID-19 restrictions had prevented him from obtaining legal advice and asked for an extension. The WRC found the complaints were submitted outside the six-month limit and that his explanation did not sufficiently account for the delay.
