The Workplace Relations Commission awarded George Breban €2,000 after finding that K.C.K TV & Electrical Company Limited unfairly dismissed him. It also ordered the company to pay €500 for failing to provide one week’s statutory notice and €500 for not giving him written terms of employment. The decision was dated 17 August 2022.
Breban, a delivery driver and appliance installer, said he was dismissed without fair procedures after a dispute about wearing a face covering. The company said it dismissed him because he refused to wear one while serving customers. The adjudicator found he had been dismissed by phone without a proper investigation, disciplinary procedure, representation or appeal. Breban had significantly contributed to his own dismissal, made no meaningful effort to reduce his losses and had negligible loss, findings the adjudicator considered when setting the €2,000 compensation.
Two other complaints, about equality and working time, were withdrawn. The minimum-notice complaint succeeded because Breban had not received the one week’s notice due to him. The written-terms complaint was upheld after the company accepted it had not provided him with those terms.
