The Workplace Relations Commission found Sheila Foley’s complaints about changes to her employment terms and constructive dismissal were not well founded. The decision was dated 3 January 2023. Foley said her duties and workload diminished after the dental practice changed hands and a Business Manager was appointed. She also said she resigned after the respondent’s chief executive shouted at her over a work task. Wishmill Ltd Friary Court Dental denied the allegations, saying her terms had not materially changed and she resigned without using the grievance procedure. The adjudicator found the changes to Foley’s duties did not significantly alter her terms. She also found Foley had not used the grievance procedure before resigning and that the respondent had not issued her a verbal or written warning. Both complaints were therefore found not well founded.
