The Workplace Relations Commission awarded Dragos Tone €1,184.99 in deducted wages after Gary Keville Traffic Management Limited withheld his final two weeks’ pay to recover training and equipment costs. The decision was dated 23 May 2022. The adjudication officer found the deductions were not fair or reasonable because they took all of Tone’s wages, leaving him without income, while the company benefited from the training and equipment. The WRC also awarded €100 for a breach of his annual leave rights and €25 for a public holiday pay breach. Tone claimed €215.54 in unpaid holiday pay. The officer found he was due an additional €18.20 for the public holiday but awarded €25 for the statutory breach. The €100 annual leave award was redress for a breach of a statutory right, not unpaid wages.
