The Workplace Relations Commission found Tomislav Vrckovic’s complaint that he was unfairly selected for redundancy by Menzies Aviation (Ireland) Limited was not well founded. In a decision dated 17 August 2023, the adjudication officer found that a genuine redundancy situation existed and that the company used a fair selection process. Vrckovic worked as a ramp agent at Dublin Airport. He argued that he had been selected unfairly, noting that his service fell eight days short of the two years required for statutory redundancy pay. The company said it consulted employees and applied the same selection criteria across the ramp agent group. The officer said the selection matrix assessed skills, length of service, disciplinary record and punctuality, and that the criteria were applied to all employees in the relevant pool. Vrckovic scored 36 points; employees selected for redundancy had scores below 38. The officer found no evidence that he was selected to avoid paying statutory redundancy.
