WRC rules it cannot hear Michael Folan’s unfair dismissal claim

The Workplace Relations Commission found it had no jurisdiction to hear Michael Folan’s unfair dismissal complaint against Heaney Meats Catering Company Ltd trading as BWG Foods. The decision was dated 17 August 2023; the merits were not decided. Folan said he had worked for the company from August 2020 and met the service requirement. The respondent said he had been employed directly from 22 July 2021 and had about eight months’ service when dismissed in March 2022. The Adjudication Officer found Folan’s direct employment began on 22 July 2021, leaving him short of the one year of service required to bring the claim.
