The Workplace Relations Commission ordered Total Tiles Ltd Italian Tile and Stone to pay Anthony Kennedy €2,258.76 for unfair dismissal and €1,129.38 in lieu of two weeks’ notice. The decision was dated 31 March 2022. Kennedy worked for the company from 18 April 2016 until his dismissal on 5 May 2020. He said he did not want his employment to end and was dismissed without notice after being pressed to accept workplace changes. The company said he was dismissed after failing to commit to its business plan and disputing that mileage payments were wages; it accepted that minimum notice pay was due. The adjudication officer found that no disciplinary interview was held, Kennedy was not offered representation and he had no opportunity to appeal. The officer found the dismissal unfair and ordered compensation equal to four weeks’ pay. The officer also noted that Kennedy gave no evidence of efforts to reduce his loss.
