Coru dismissal of Punam Chuniyani was fair, WRC finds

The Workplace Relations Commission found that Coru fairly dismissed Punam Chuniyani after a probation process that extended beyond her first year of service. The decision, dated 31 March 2022, rejected her unfair dismissal complaint.

Chuniyani said she was denied union representation and a fair appeal process, and alleged discrimination connected with her nationality. Coru said it had provided training and support, raised performance concerns and given her opportunities to respond.

The WRC found the Unfair Dismissals Act applied because her notice period ended on 12 June 2020, just beyond one year after she started work. It concluded Coru had fair grounds related to her competence and had followed a fair process. Her separate Employment Equality Act complaint was withdrawn at the hearing.
