The Workplace Relations Commission found Brian Buckley was unfairly dismissed and awarded him €20,849.40 for financial loss. In a decision dated 7 January 2022, it also awarded him €6,415.20 for unpaid notice and €1,603.80 over an inaccurate and late employment contract.
The WRC accepted Buckley’s account that he worked five and a half days a week and earned €700 net a week. It found Pat Lawrence acted as his manager and that his words and actions ended Buckley’s employment. The employer had no justifiable reason for the dismissal and did not follow fair procedures.
Buckley had worked for Josephine Lawrence trading as K And L Motors since 1996. The WRC found he was entitled to eight weeks’ notice based on his service, and that the contract he received did not accurately record his continuous service and was provided late. Four further complaints referred in May 2020 were withdrawn.
