The Workplace Relations Commission awarded film stagehand Raymond Lyons €5,337.68 after finding his written employment terms were deficient. The WRC decision, dated 15 December 2023, also found his complaint about unpaid wages during a lay-off was not well founded.
Lyons worked on film and television productions for Metropolitan Films International Limited. He said he was not called back to work after a 2018 lay-off because of his membership of the Irish Film Workers Association. The company disputed that it was his employer and argued his complaints were late; the adjudication officer found the company was his employer and that the complaints were within the time limit.
The WRC found the employment document gave the wrong employer details and start date, and awarded compensation equivalent to four weeks’ pay. It found that wages were not payable during the lay-off when Lyons did no work, so the failure to pay them was not an illegal deduction. His separate complaint under working-time legislation was withdrawn.
