The Workplace Relations Commission found Marta Klinkosz was unfairly dismissed by E-Celtic Ltd and ordered €30,578 compensation. The decision was dated 13 December 2022. Four other complaints were found not well-founded.
Klinkosz said she was told her job was ending because there was not enough work, then was given performance reasons. The company said it dismissed her over performance and said it lost a public contract because of her work.
The adjudicator rejected the performance allegations and found the company had not justified the dismissal on performance or redundancy grounds. The compensation included €25,000 for actual and prospective loss and €5,578 for lost redundancy rights. The complaints about redundancy pay, underpayment and the ending of employment under the Protection of Employment Regulations were found not well-founded; the shortfall in pay had later been paid.
