The Workplace Relations Commission found David Mc Myler had not established a case of direct or indirect age discrimination in a promotion competition for an Irish Coast Guard manager role. The decision was dated 13 December 2022.
Mc Myler, who had 39 years of service in the Irish Coastguard and previously in the Irish Naval Service, said the competition’s design and conduct discriminated against him after he was unsuccessful at interview. The Department of Transport denied discrimination.
The adjudicator found that the competition design and interview process did not raise an inference of age discrimination and that Mc Myler had not established a prima facie case. The complaint was not well-founded.
