The Workplace Relations Commission rejected a senior manager’s claim for a €15,000 bonus from a security services company. In a decision dated 2 May 2017, the WRC found that the non-payment was not an unlawful deduction from wages.
The manager said he remained entitled to a full-year Business Performance Plan bonus after moving to a European director role in July 2015. He sought the remaining €15,000 from a claimed €30,000 gross bonus. The company said the promotion ended his eligibility for that scheme and brought him into a different bonus plan for the second half of the year.
The adjudication officer found that the manager accepted the new role and its benefits, along with the change to his bonus arrangements. He was not entitled to a further €15,000 under the earlier plan for July to December 2015, so its non-payment did not breach the Payment of Wages Act.
The complaint failed. The WRC made no additional bonus award.
