Supermarket chain discriminated against warehouse worker over accommodation delay

By Fionn Kelly

Workplace Relations Commission ·

The Workplace Relations Commission found that a supermarket chain discriminated against a warehouse worker by taking too long to assess his need for reasonable accommodation. It awarded him €3,500. The decision was dated 9 May 2017. The worker said he told managers about his degenerative eye condition in December 2014. The WRC accepted that he had disclosed the condition then and found that, despite delays caused by the worker, the employer took too long to assess his return to work and look for a suitable alternative role. His separate victimisation claim failed. The November 2015 complaint was considered within the decision on the April 2016 complaint.
