The Labour Court upheld Celine Gaynor’s unfair-dismissal complaint and increased her compensation from €4,000 to €20,000 on her appeal. The determination was signed on 8 May 2017.
Gaynor worked as a credit supervisor for Ewl Electric Limited. The Court did not assess her allegations of bullying and harassment. It found that the employer had not met basic fair-procedure requirements: it dismissed her for incapacity without apparent medical validation and did not arrange an appeal after she said she wanted to challenge the dismissal.
The Court awarded €20,000 for financial loss, in addition to sums paid when her employment ended, and varied the Adjudication Officer’s decision. The earlier decision had awarded €4,000 compensation.
