Labour Court finds Shannon Development failed to honour pay-scale commitment to worker

The Labour Court found that Shannon Development had made but failed to implement a commitment to keep a worker on his existing salary scale and grade. In a recommendation dated 1 May 1998, it said the company and the Services Industrial Professional Technical Union should meet to agree how to put the situation right.

The worker transferred from Shannonside Tourism to Shannon Development in 1987. The union said the company placed him on a lower scale than promised and that he was owed arrears. Shannon Development said the E3B scale had applied since 1987 and that his post did not warrant a higher grade.

A Rights Commissioner had recommended a £12,000 ex-gratia payment, but the Labour Court did not award that sum. Instead, it recommended the parties meet to agree a remedy.
