In 1989, the Labour Court upheld a Rights Commissioner’s recommendation against compensation for a worker at Mitsui Denman (Ireland) Limited, while deleting its concluding sentence. The decision was signed on 31 January 1989. The worker, represented by the Irish Transport And General Workers Union, lost a 20% shift premium, moved from grade 2 to grade 3 and lost £44 a week after a reorganisation. The union argued that his standard of living had fallen; the company said he had received the monetary terms agreed under its action and corrective plan. The Court found no grounds to recommend compensation in view of the plan agreed between the company and unions. It upheld the recommendation on compensation but deleted its final sentence as no longer relevant after later events and the company’s comments about the worker’s potential.
