The Labour Court rejected a truck driver's appeal for increased compensation and upheld a £300 recommendation to be paid by Kona Products Limited. The decision was signed on 15 May 1989. The worker said he had told the company he planned to take July holidays, then returned to find a replacement had been hired and received neither holiday pay nor pay in lieu of notice. Kona Products Limited said he knew July was a peak period for the seasonal business and that it had not intended to deny his holiday entitlement. The Rights Commissioner had found that the worker was unfairly dismissed but that his actions contributed to his difficulties, and recommended £300 in full and final settlement of his claims. The Labour Court found no grounds to change that recommendation.
