The Labour Court upheld a Rights Commissioner’s recommendation in a worker’s appeal against Fingal County Council, in a decision signed on 28 September 2009. The worker, represented by James Cody & Sons Solicitors, raised concerns about a transfer to Malahide, sick pay, overtime, complaint handling, alleged bullying or discrimination, and training. The worker said the €4,600 overtime claim was refused as late and that the transfer left him without sick pay for a number of months. The Council said it had acted fairly and that the worker was treated consistently with other employees. The Court endorsed the Rights Commissioner’s recommendation, said the Council’s overtime-claim process should be adopted and implemented by the parties, and found the Council’s position on training courses reasonable.
