Keegan Quarries Ltd sought a High Court injunction against Thomas Donegan over alleged obstruction of access to its disused quarry, in an application before Mr Justice Mark Sanfey on 9 February 2022.

The company claimed it held a right of way across Donegan’s land to reach the quarry near Newcastle, about 3.5km from Enfield, Co Meath. The court heard that the site could only be reached from the public road through his property. The report said Donegan was claimed to maintain that the right of way was more limited.

KQL said extraction at the quarry had stopped in 2019, but it planned restoration work and needed access for regular safety inspections. It alleged that Donegan had blocked the entrance with heavy machinery and agricultural produce, including silage bales.

The judge granted the company permission to serve short notice of the injunction proceedings. The case was due back before the court the following week.
