Robert Duffy loses challenge to extradition for murder

By Gráinne Nolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Robert Duffy’s challenge to an extradition warrant for murder was dismissed by the High Court in Belfast on 21 June 2022. The warrant seeks his return from the Republic of Ireland to Northern Ireland to serve the remainder of his life sentence for John Gibson’s murder.

Duffy had argued that the warrant should not have been issued without further inquiry into whether he remained a danger to the public, and that the delay amounted to an abuse of process. The court held that assessing risk was not the District Judge’s role in issuing the warrant; those issues could be raised before the Sentence Review Commissioners.

The court found that the statutory conditions for issuing the warrant had been met and dismissed all grounds of challenge. It said the proper procedure was for Duffy to be extradited under the warrant, with the right to apply for release after his return.

This report covers an earlier stage of the case. Later developments are not reported here.
