Eric Eoin Marques lost his High Court challenge to extradition over alleged child pornography offences in a judgment delivered on 30 November 2017. The court refused his request to quash the Minister for Justice and Equality’s surrender order to the United States.
Marques had argued that the minister should obtain and consider the Director of Public Prosecutions’ reasons for not prosecuting him in Ireland. Ms Justice Donnelly held that the minister was not obliged to obtain those reasons and had given sufficient regard to the reasons advanced against surrender.
