Bernard Fogarty and Robert Redmond were charged with murder after the man they were accused of attempting to murder died in hospital. The proceedings were reported on 11 March 2022.

The murder charge relates to an incident at Madigan's Yard, Kileek Lane, Swords, Co Dublin, on 17 January 2020. The man died on 21 February 2021 after a lengthy spell in hospital. Fogarty and Redmond had been charged with his attempted murder in April 2021.

Both men were also charged with assault causing harm to Gerard Wildman on the same date and with possession of a firearm and ammunition, namely .38/.357 calibre bullets, with intent to endanger life or cause serious injury on the same occasion.

On 11 March 2022, the Special Criminal Court accepted jurisdiction over the murder cases. State solicitor Ciara Vibien said the attempted murder charges were to be withdrawn and replaced by murder charges, and that Books of Evidence had been served on both men.

Presiding judge Mr Justice Tony Hunt, sitting with Judge Gerard Griffin and Judge Cormac Dunne, allowed the application and said the attempted murder charges were to be withdrawn. The existing trial date of 15 June 2022 remained in place. Both men confirmed their names when presented with the upgraded charges.
