Andrius Kozlovskis told the manslaughter trial of his partner, Bernadette Scully, that she would never have hurt her daughter, Emily Barut. Scully has pleaded not guilty to Emily’s manslaughter at their home at Emvale, Bachelor’s Walk in Tullamore. Emily was 11 when she died on 15 September 2012. The proceedings were reported on 30 November 2016.
The prosecution alleges that Scully administered a toxic level of chloral hydrate and killed Emily through gross negligence, breaching her duty of care as both mother and doctor. The report said Emily had severe physical and learning disabilities, had undergone surgery a few weeks before her death and was in pain and struggling to sleep.
Kozlovskis said Emily was cold when he checked on her and that he panicked when he could not wake Scully. The report said she was unconscious after taking an overdose. He said he never thought she was suicidal and that they never spoke about how their lives would have been without Emily. He described Emily as Scully’s “number one priority” and said he did not think Scully saw her life without her.
