Labour Court upholds dismissal of Shane O’Connor’s late unfair-dismissal appeal

The Labour Court upheld the dismissal of Shane O’Connor’s unfair-dismissal complaint against Techrete Ireland Ltd because it was filed outside the statutory time limit. The determination is dated 4 March 2025. O’Connor resigned by WhatsApp on 21 August 2022, giving two weeks’ notice. The Court treated the resignation date as the end of employment. The WRC received his complaint on 1 March 2023. O’Connor argued that his notice period affected the deadline and cited other reasons for delay. The Court found those reasons did not explain or excuse the late complaint, declined an extension and did not hear the merits.
