The Labour Court awarded Oliver Dixon €5,000 after finding his dismissal by Francis Brophy & Company Chartered Accountants unfair on procedural grounds. In its decision signed 18 December 2024, the Court varied the adjudication officer’s earlier finding that his complaint was not well-founded. The Court said the firm could reasonably have dismissed Dixon for serious misconduct, after he presented private client work as the firm’s and used its name and stationery. But it found that the principal, who was a key witness, was not impartial as decision-maker and failed to give proper weight to mitigating factors or consider alternatives. The Court said Dixon contributed significantly to his dismissal.
