The Labour Court set aside an earlier ruling and awarded Brian Healy €10,000 after finding his redundancy dismissal unfair. The decision was signed on 24 July 2024.
Healy had worked for Pilvine Ltd Trading As Positive Signs since 2016 as a sign fitter. The company said falling demand for sign fitting led it to outsource the work and remove his role. Healy argued another worker who also fitted signs should have been considered in the redundancy selection.
The Court accepted that there was a genuine redundancy situation, but found the company had not shown that it considered alternatives or explained why Healy was selected instead of the other worker. It noted that Healy had carried out about 70 to 80 site jobs in the relevant period, compared with about 60 to 70 by the other worker. The €10,000 compensation is in addition to any statutory redundancy payment Healy had already received.
