The Labour Court rejected Mr Tabish Shahid Shaikh’s appeal against Infosys Ltd over his unfair dismissal, finding that a concern he raised about the Splunk tool was not a protected disclosure. The Court’s determination was dated 24 October 2022 and affirmed the WRC decision.

Mr Shaikh said information that should have been visible only to a client had been published on a portal, and that he was dismissed in retaliation for raising the issue. Infosys said the tool problem was technical, his assignment ended because the client no longer needed the role, and his employment ended after he failed to confirm travel arrangements back to India.

The Court found the problem concerned the tool itself rather than an act or omission by the employer, so it could not amount to a relevant wrongdoing under the Act. It also found no basis to believe the issue led Infosys to dismiss him. The appeal failed and the WRC decision was affirmed.
