Labour Court upholds decision that worker’s dismissal complaint was out of time

The Labour Court upheld the decision that a worker’s unfair-dismissal complaint was brought outside the time limit and that the Court had no jurisdiction to hear the appeal; the merits were not decided. The determination was dated 17 May 2022. The worker said health difficulties and other circumstances prevented him from filing in time. The company argued that he had pursued other claims during the same period. The Court found he had not shown a factor that prevented him from submitting his complaint within the time limit.
