The Labour Court ruled it had no jurisdiction to hear Deirdre Morgan’s unfair-dismissal appeal because it was filed one day after the 42-day deadline. The merits were not decided, and the original €1,500 award was not reviewed. The determination was signed on 2 December 2020. The Adjudication Officer had upheld Morgan’s complaint, found she had substantially contributed to her dismissal and awarded her €1,500. Morgan said changes to Labour Court rules affected her ability to appeal on time, but the Court found she had not identified a change that prevented her filing within the deadline. Sandra Cooneys Home Care Ltd argued that there were no exceptional circumstances and noted that Morgan had filed two other appeals on time.
