The Labour Court upheld Elite Private Security Ltd T/A Greenshield Elite’s appeal and set aside the €5,000 award to Stefan Georgiev, finding that he had not been dismissed. The determination was dated 6 August 2019.
Georgiev said the company dismissed him without explanation after he objected to changes in his work locations. The company said he requested his P45 after refusing shifts. The Court preferred the company’s account, citing messages about the P45 and evidence that Georgiev worked and was paid for a shift on 8 April 2017. His minimum notice complaint also failed, and the Court set aside the decision on that complaint.
